Welcome to Terra Medical Tourism (“Terra”, “we”, “us”, “our”). By accessing or using our website and any services offered through it, including travel or medical travel packages, you (“you”, “client”, “patient”) agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services or website.
1. Scope and Acceptance
1.1 These Terms & Conditions govern your use of the Terra website and any services we provide, including but not limited to: medical travel arrangements, scheduling, accommodation, transportation, partnerships with clinics or hospitals, visa or immigration assistance.
1.2 By using our website, making inquiries, booking or paying deposits or full fees, you acknowledge that you have read, understood, and accepted these terms in full.
2. Medical Disclaimer
2.1 Terra is not a health care provider. We act as a facilitator connecting clients with medical providers, travel arrangements, and related services.
2.2 All medical procedures, diagnoses, treatment plans, and follow-up care are the responsibility of the medical practitioners or institutions you select. Terra does not warrant or guarantee specific medical outcomes.
2.3 You should always consult with a qualified health care professional in your home province (Ontario) or country before beginning any treatment abroad or arranged through us.
2.4 Information provided on our site, in marketing material, or by our staff (including testimonials, photos, before/after imagery) is for informational purposes only and may not reflect your individual results.
3. Service Descriptions & Changes
3.1 We endeavour to ensure that the descriptions of services (medical, travel, accommodation, transportation) are accurate and up to date.
3.2 However, all itineraries, pricing, availability, package details are subject to change without prior notice due to factors including but not limited to: changes in medical provider availability, visa/immigration regulations, transportation or travel disruptions, currency fluctuations, or unforeseen events.
3.3 Terra will make reasonable efforts to notify you of any material changes before you travel or proceed with services when possible.
4. Booking, Payments & Deposits
4.1 Upon booking a package or service, you may be required to pay a deposit. The specific deposit amount and due date will be disclosed in your quote or contract.
4.2 The remaining balance must be paid by the agreed deadline prior to departure or service commencement. Failure to pay may result in cancellation or suspension of services.
4.3 Payment methods accepted will be specified and may include credit card, bank transfer, or other means. Any fees (e.g. transaction fees, international banking charges) are your responsibility unless otherwise stated.
5. Cancellation, Refunds & Rescheduling
5.1 If you cancel a confirmed service or package, refunds (if any) will depend on the timing of cancellation relative to service dates, and the policies of the medical providers, accommodation, transport, etc.
5.2 Terra will provide you with the cancellation policy applicable to your package at or before booking.
5.3 Rescheduling may incur additional fees or changes in price. Terra is not responsible for penalties imposed by third-party providers due to cancellations or rescheduling.
5.4 Non-refundable costs (e.g. non-refundable flights, medical provider fees) may apply and will be disclosed when known.
6. Assumption of Risk
6.1 You acknowledge that travel and medical procedures involve risk, including risks associated with surgery, anesthesia, infection, travel delays, etc.
6.2 You assume full responsibility for personal injury, illness, death, or property damage which may occur during or as a result of using Terra’s services or those arranged through us.
7. Health Insurance and Regulatory Compliance
7.1 It is your responsibility to ensure you have adequate health, travel, and medical insurance to cover unexpected events, medical complications, emergency evacuation, or repatriation. Terra strongly recommends purchasing insurance (domestic & international) for these risks.
7.2 Terra does not guarantee that any medical provider or facility abroad meets the same standards as in Ontario; you should verify licensing, credentials, host country regulations, and facility accreditation.
7.3 You are responsible for ensuring compliance with immigration, visa, customs and health regulations, both for Ontario/Canada and destination country.
8. Privacy and Personal Information
8.1 We collect and process your personal and health-related data as needed to provide our services. We will do so in accordance with applicable laws, including Ontario’s Personal Health Information Protection Act (PHIPA), the Personal Information Protection and Electronic Documents Act (PIPEDA), or other relevant laws.
8.2 We will require your consent for any collection, use, or disclosure of personal or medical data.
8.3 We will take reasonable steps to protect your information, but cannot guarantee impossibility of all risks (e.g. hacking, unauthorized access).
9. Limitation of Liability
9.1 To the fullest extent permitted by law, Terra’s liability to you for any losses arising from your use of our website or services (including third-party services we facilitate) is limited. Terra will not be liable for indirect, incidental, special, consequential, or punitive damages.
9.2 Terra’s maximum aggregate liability for any claim arising out of or in connection with these terms will not exceed the amount you have paid to Terra for the specific service or package giving rise to the claim.
10. Intellectual Property
10.1 All content on the Terra website (text, graphics, logos, images, videos, etc.) is owned by or licensed to Terra. You may view, download, or print portions for personal, non-commercial use only.
10.2 You may not reproduce, distribute, publish, or exploit content for commercial purposes without Terra’s prior written consent.
11. Governing Law & Dispute Resolution
11.1 These Terms & Conditions are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
11.2 Any dispute, claim, or controversy arising out of or relating in any way to these Terms, your use of Terra’s services, or any packages shall be resolved in the courts of Ontario.
11.3 Before initiating formal legal action, both parties agree to attempt to resolve disputes via mediation or arbitration (if mutually agreed) in good faith.
12. Modifications of Terms
12.1 Terra may modify or update these Terms & Conditions from time to time. The updated version will be posted on the website, along with a new “Last Updated” date.
12.2 Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
13. Miscellaneous
13.1 If any provision of these Terms is held invalid or unenforceable, such provision shall be struck out or modified to the minimum extent necessary, and the remainder of these Terms shall remain in full force and effect.
13.2 These Terms, together with any contract, quote, or agreement you sign with us for specific services, constitute the entire agreement between you and Terra regarding the services in question, superseding any prior understandings, communications, or agreements
